Mechanic's Liens - Friday's Free Form - Notice of Intent to Lien - General Contractor

How many times have you been in this situation: You are owed money on a construction project and are thinking of filing a mechanic's lien. But you know that after filing it there will begin a serious dispute process, and probably involving the hiring of lawyers on each side. You would like to send a notice to the other side telling them that if it is not paid, more serious steps will be taken. Well, there is a form to be used in this situation. In my experience, this is a very popular form--so much so we would like to make it available to the construction industry.

This form below warns the owner that you will be filing a mechanic's lien if payment is not made within ten days. Hopefully, it will create a serious dialogue for settlement. Come up with your bottom line amount to settle and be prepared to offer it to the owner if he or she is negotiating in good faith. Remember that the last thing an owner wants is a lien on their property: it jeopardizes title, interferes with their relationship with the construction lender, and prevents refinancing or sale. This Notice is worded in a non-threatening manner so as to capitalize on this situation, with the owner knowing that you are required by law to file a lien within a set period of time or lose your lien rights.

WHO CAN USE THIS FORM? All persons, whether general contractor, subcontractor, or supplier.

HOW TO SERVE: There is no need to file this with the court or record with the recorder's office. It is simply served by mailing.

WHO TO SERVE: If you are a general contractor, serve the owner and construction lender. If you are a subcontractor or supplier, serve the owner, general, and construction lender.

HOW TO SERVE: Although not required, it is recommended for its effectiveness to be served by certified mail.

WHEN: Serve ten days before you file or record the mechanic's lien. Remember, it does not extend the time to file a mechanic's lien.

Mechanic's Liens - How to Get Paid Guide - How Long Does a Lien Stay on the Property?

There is a misconception that once a mechanics lien is filed or recorded against the property, it stays of record indefinitely, similar to a grant deed or mortgage. This is not the case. Each state has their specific rule as to how long it stays on the property. For example, in California, the lien is only good for 90 days after recording. Before that time you must bring a lawsuit to foreclose or the lien becomes null and void. Please consult our web site to see exactly what the time periods are for your specific state.

This is a misconception because of how the recorder's office works. When you file or record the mechanics lien, it becomes a matter of public record. If the time expires to file your lawsuit it doesn't automatically erase off the record, like a deleted computer program. It stays a matter of record, although it is not enforceable. For this reason, some people mistakenly think that as long as it stays on the record, it is valid.

For this reason, many lawyers use the phrase: "A mechanic's lien is no better than the lawsuit to foreclose it". This means that filing the lien is only the first step. Unless you follow up with a lawsuit to foreclose, at which time the judge decides the validity of lien, it will no longer have legal affect. Unfortunately, this usually means hiring an attorney to bring the lawsuit, which is not cheap. On the flip side, the good news is that few lawsuits go to judgment and foreclosure and are usually settled well before trial.

So what do you do if the time has expired to bring the lawsuit to foreclose? How can you take the lien off? Some states allow you to bring a special motion or petition to expunge the record but this can also be expensive. If you win, the court might also have the power to assess attorneys' fees against the stubborn party. The best thing is to have your attorney write a demand letter to the lien claimant indicating it is slandering title and is invalid. Enclose a release of mechanic's lien along with that the demand letter. This is a special type of release because it does not indicate payment has been made, but simply that the lien has expired and is being released. If this does not work, you can either leave it that way or bring a petition to expunge. Hopefully, you could also explain to your title company if you later sell, that as a matter of law, the time has expired and even though it is still of record, it is no longer enforceable.

Unfortunately, some lien claimants are stubborn and become so emotionally involved, they refuse to release the lien--even though it is no longer valid. In such cases you are essentially forced to bring some form of court action. But there is one other possibility. Contact your state contractor's license board and see if it is grounds for discipline for a contractor to keep in place an invalid lien. If that is the situation, you can bring a complaint yourself, without hiring an attorney, and force the hand of the contractor.

Beast Mastery Hunter in WoW - Facts and Tiers For BM Hunter Spec in WotLK

Focusing on the Beast Mastery talent tree is seen as a good idea for leveling and grinding in general. Focusing on this talent tree will make your pet into a great damage dealing tank that will be able to take a lot of damage and do a very decent job of it as well.

Specing in Beast Mastery hunter in WoW will rarely cause you to pull aggro from your pet because you get some abilities that will stop that from happening, so this is definitely a great leveling build.

It's true that with a Beast Mastery build your hunter won't be as strong as he could be on a Marksmanship build, nor will you have the combat bonuses to ensure your continued survival like with a Survivalist build, but for fighting mobs and leveling up it does the job nice. You can do rather OK in PvP as well although not stellar, as for end-game raiding, you'll have to re-spec.

There are a couple of talents that you need to have in order to make the most out of your Beast Mastery build:

o Tier 1 - Both Improved Aspect of the Hawk and Endurance Training are useful and are must-have.

o Tier 2 - Focused Fire and Thick Hide are must-haves, Improves Aspect of the Monkey not so much while Improved Revive Pet may or may not prove useful depending on your play style.

o Tier 3 - Pathfinding is good only for the first 30 or so levels until you get your first mount after that it's going to be useless, however Unleashed Fury is a definite must-have for this sort of build.

Other important talents that you'll need are Ferocity, Intimidation, Bestial Wrath, The Beast Within, Kindred Spirits and of course Beast Mastery.

The Top RPG PC Games of All Time - Part 1

In my opinion, RPG games are some of the funnest games around to play. You usually get cool weapons and cool armour not to mention some really badass names you can give yourself. This shortlist below are what I believe are some of the best RPG PC games of all time.

Neverwinter Nights:
Dungeons and Dragons has for years been one of the most popular pen and pad RPG's of all time. Some early attempts at a top RPG PC game were made, Baldur's Gate (I and II) were based off DnD version 2 and proved super successful. No one yet had taken the very new rules of version 3 and turned it into a great game.

Bioware and Atari however brought to life a new style that mixed popular RPG format with the rules of Dungeon's and Dragons. Difficult skills and feats were scraped or simplified because while Baldur's Gate was turn based, Neverwinter Nights was real time. This made the overall game much more playable and fast paced which in turn made it more exciting. The gameplay is backed by a strong storyline which takes from the city of Neverwinter on a journey across the world.

Two expansions were made. The first one began an entirely new story and moved the level cap from 10 to 20. The second expansion concluded the first taking your character deep into hell and the level cap all the way to 40. The amount of content in this game truly makes it one of top RPG PC games of all time.

Neverwinter Nights 2 on the other hand was quite clunky and seemed a little rushed which was a shame as Bioware is usually known for it's quality.

Diablo series:
Diablo brought something to the RPG scene that no one had ever done before. An in depth, long story line with amazing graphics and super easy to play. The story line fitted well with the quests, there was always plenty of new gear and it was easy to customize your character at each level up. The game was simply just fun.

Diablo II brought around a new engine with better graphics, there was also a fantastic mulitplayer feature built in. You could either play on one of the ladder servers online and earn your way to the best equipment and highest levels or you could start up a LAN game with friends and battle against the evil forces together.

Diablo III has been announced to be released as early as 2011. It promises new graphics, new classes and a new mysterious storyline. The Diablo series have really defined themselves as some of the top PC RPG games of all time. I'm sure Diablo III will not disappoint.

Toyota Hybrid Sports Car

Every loyal customer to Toyota and the people behind the company itself are looking forward to 2008. Why? Because that is the slated release for the much-awaited Toyota hybrid sports car dubbed the Volta. Toyota has always been known to set itself apart from all other car manufacturers, releasing some of the most outrageous designs that seem to grow onto society once the cars establish themselves as bestsellers.

Japan Goes Italian

Toyota's hybrid sports car can only be a real head turner. This is what's expected when you have an elite group of designers to give the new concept car a new, nice Italian twist. Pictures of the concept car have emerged from the company itself and the first thing that may come to mind is the Lamborghini Diablo; only the Volta is eco-friendly.

Toyota believes that hybrid technology can also be used in high-performance vehicles such as the Toyota Volta. After all, it is rumored to go from 0-60 in 4 seconds and has a top speed of 155 mph; not as fast as the Diablo or any Ferrari but the important thing is how much gas this vehicle doesn't use.

The Name Game

The 2008 new Toyota Volta will be paying homage to Alessandro Volta, the man who came up with the electric battery in 1800. It is only very apt considering that this vehicle does run on a type of battery. The Volta runs a V6 engine and there's an electric motor on each axle.

The electric motor will be used to operate several things at the same time such as, for example, a computer that operates the movement of the wheels, activation of brakes, etc.; basically something known as drive by wire, a technology that is fitted into modern fighter jets, so you can imagine how much time in design was spent on this near-future release. This technology also allows for an awkward feature that can have the passengers reposition the steering wheel and pedals in front of them.

Economy

Two centuries after the invention of the electric battery after which the new hybrid is named, Toyota aims to have the Volta out and running by 2008. It is expected to have a tank that holds only 13.7 gallons that will allow it to go 435 miles when filled up. Plus, if 408 horsepower isn't enough, you will just have to weight for later versions of the Volta because this is the top speed estimated for the initial release.

Toyota France expects to release this to the European market in 2008. However, Germany might be happy to know that the car will be for sale there by December of 2007. Experts are speculating that prices for the Toyota hybrid sports car will range from $72,000 to $165,000 in the US market once it hits North American shores.

Whether or not the market is ready for this sports car, Toyota itself is ready to prove that hybrid technology does belong in the automobile industry and will suit any purpose and application.
